Although some aspects of the child custody process are self-explanatory and straightforward, others can be confusing, particularly for parents who have little previous experience with the legal system. One example of this is the concept of child custody guardianship, which plays a key role at a number of different stages in the custody determination process. In disputed custody cases, the court will appoint a third party, typically another lawyer, to ensure that the best interests of the child are being upheld. This role is referred to as the guardian ad litem. In other situations, the court may appoint guardianship to another relative or, in some cases, a close family friend if it is determined that neither parent is fit to assume custody of the child. This type of child custody guardianship is usually temporary, and lasts during the period before the custody hearing proceeds and a final order can be issued.
