Custodial Parent

The custodial parent in a situation is the parent who has the most rights to the child. This parent is responsible for the well-being and rearing of the child. In most cases, the child resides in the home of the custodial parent. In most arrangements, the child is not living with both of his or her parents. It is common for a parent have the designation as a custodial parent in situations of divorce or separation. In other instances, it becomes important to define this parent as the one who makes decisions for the child. Courts will base their decision on who should fill this role based on one or more reasons. Generally, the child's well being is in consideration first. Financial, emotional strength and the child's wishes may also be in consideration.
