Grandparents Visitation

Grandparent's visitation is one of the most controversial of the laws concerning custody arrangements for children in divorce, separation or other non cohabitating situations. Although laws in the early 2000's were being considered and in some cases imposed statewide, there are no federal laws under which a grandparent is given visitation rights to the child. Arguments for the grandparent's rights often include the fact that many grandparents can provide stabilizing roles for their grandchildren and that they can offer reassurance in traumatic events. Arguments against these rights indicate that the state should not be making child rearing decisions in cases where parents are competent, and that in some instances, the exclusion of the grandparent may be in the best interest of the child.
