I had a one-night stand with a woman, and I found out two years later that she had a baby that was mine. She admits the baby is mine, but my name isn’t on the birth certificate. She’s a bad mother, and I want to sue for at least partial custody but she says it is too late because the baby is already 2. Is this true, can I sue for custody of a baby that is already two years old if I didn’t know about him before?

Although the laws vary by state, if you were unaware of the child up until this point, you should be able to petition the court for access to the child. Your rights to the child may depend on establishing paternity if it is in question, especially if your name is not on the birth certificate.
