New Jersey Supreme Court Says that Child Custody Can Be Decided by Mediator

The Supreme Court of New Jersey recently made a unanimous decision regarding the handling of child custody issues within the state. According to the new laws, a couple can decide to resolve their alimony and child custody disputes outside of a courtroom, using an agreed-upon mediator. This individual is responsible for overseeing all arbitration, and granting the custodial rights.
The decision was made to offer the opportunity for families to avoid the stress and hassle of fighting over children in court. This is generally accepted to be easier on the children, as well. The Supreme Court also considered the state of the state’s court system. It is so backlogged with pending divorces and custodial suits, that many families are forced to wait months or even years to have even a preliminary hearing.
By utilizing an arbitrator, couples are able to sidestep the complicated and often painful judicial process and get straight back to rebuilding their lives and caring for their children.
