Temporary Child Custody In Florida Extended To A Family Member

HB 109 CS - GENERAL BILL   by Anderson (CO-SPONSORS) Clarke; Culp; Waters;

RECOMMENDED: by Justice Council

Temporary Custody of a Child by an Extended Family Member: Removes provisions related to putative fathers; defines the term "extended family member"; removes the definition of the term "putative father"; authorizes an extended family member to bring a proceeding in court to determine the temporary custody of a child; specifies the information that must be included in a petition for temporary custody by an extended family member; provides that only an extended family member may file a petition for temporary custody under ch. 751, F.S.; authorizes a court to redirect child support payments to an extended family member; requires that the court order payment of arrearages; removes reference to an order granting temporary custody of a minor child to a putative father; provides that either or both of the child's parents may petition the court to modify the order granting temporary custody.
