Many times when you think about custody battles between two people or a need for custody agreements to be made you think of couples that are divorcing but this can also be true of couples that were never actually married to begin with. Even if two people are not married, if they are the biological parent of a child they are to share custody unless it is decided that the custody should be a different way.

When it comes to custody between two unmarried individuals it tends to be that if the father does not try to get custody in any way then the mother more than likely will be automatically given the custody. However, many things are taken into regards considering that custody is awarded to the person where it seems as though those having custody would be most beneficial to the child. This can mean that if a parent has not been a very good parent in the past they will not have a chance when it comes to custody.

There are also other types of custody or visitation rights that may be sought by people who are not married into the party or who have other situations. One of the most common of these is grandparents getting visitation rights to be able to see their grandchildren. There are also other individuals who may seek visitation.

Some things that will be taken into consideration when going for custody are who would be the best guardian, who the child has the closest bond to, who will be able to support the child and more. Child custody battles can be a very sad and stressful thing for a child so the person who does win custody should try and make sure to take their child’s emotional reactions and more into consideration and make sure that they are okay or understand what is happening. If they are unable to then you may want to seek help to help them to be able to better understand in a caring and logical manner. While many times a mother will be favors in these situations there are many ways that a father is able to secure his rights to custody and if he is unable to win this then visitation.
